Instructions: The new Affidavit of Support regulation was published in the Federal Register on October 20, 1997. The new legally enforceable Affidavit of Support Under Section 213A of the US Immigration and Nationality Act (Form I-864), was promulgated on the same day. As required by the Illegal US Immigration Reform and Immigrant Responsibility Act of 1996, the new affidavit of support must be completed by U.S. citizens and legal permanent residents who sponsor family members as immigrants to live in the United States. The new Affidavit of Support form will be required for immigrant visa and adjustment of status applications filed on or after December 19, 1997.
